General conditions of sale

These conditions regulate the sale of goods and services offered on the website of the sculpture school ‘La ligne d’Horizon’ (‘La ligne d’horizon’)

The goods and services offered by the sculpture school include, inter alia:

  • Regular sculpture courses
  • Intensive workshops
  • Thematic workshops (clay sculpture, moulding, patine)
  • Sale of sculpture material (clay, tools, storage bags or other)’

The prices of the products and services proposed are in euros and are indicated on our site. All our prices include VAT. For online purchases, shipping costs are not included in the price shown on the website.

By registering for a course or a workshop, participants acknowledge that they have read and accepted the following general conditions, and commit to respect them.

Registration and payment

To register for a course or workshop, simply send an email to info@lalignedhorizon.brussels and ask whether there are availabilities for a course of your choice on the basis of the timetable we offer on the website.

We will reply to your email (check your spam folder). If a place is available, it will be reserved for you for a week, starting from the date of the confirmation email.

Please note that this reservation is provisional and your place will be definitively allocated only upon receipt of your down payment on our bank account. You will have one week to carry out the down payment. The full payment must be settled one week before the beginning of the course or the workshop. For lessons given as part of a course, enrolment is for the full course. There is no possibility to register for individual lessons. However, a free trial lesson is possible for students who have never attended courses at the Ligne d’horizon. Places for the courses and workshops are subject to availability. Access to the courses and workshops is only authorized after registration and payment. Any payment shall be made by bank transfer (except otherwise indicated in the confirmation email).

A staggered payment may be granted in certain cases. You can request it by e-mail at: info@lalignedhorizon.brussels. The Ligne d’horizon reserves the right to grant (or not) a staggered payment. If the number of students is not sufficient, the school reserves the right to cancel the course or workshop. Students can opt for full reimbursement or postponement of the course or workshop, according to availabilities.

Recuperation of lessons

Students who are enrolled in a course but cannot take part in a lesson can recoup the missed lesson, provided they have given prior notice by email of their absence to the Ligne d’horizon. The lesson can be recouped at a different date by common agreement with the Ligne d’horizon, subject to availability. Missed lessons must be recouped during the course period, which can be quarterly or annual. Lessons cannot be recouped during a subsequent course.

Long-term absence

If a participant enrolled in a course cannot attend several lessons due to serious illness or accident, he/she is required to inform the Ligne d’horizon without delay and provide the relevant evidence. In this case, the Ligne d’horizon may decide, but is not obliged to, ‘suspend’ the subscription.

Right of Withdrawal

Customers may withdraw from the contract within 14 days of its conclusion (date of the down payment). The customer shall duly notify La Ligne d’horizon by email at info@lalignedhorizon.brussels. Requests submitted by any other means (orally, by telephone, social media, sms) shall not be taken into account. If the customer exercises this right, no amounts can be charged to the customer. This right to withdraw from the contract ceases to apply if the course or workshop has already started and the customer has participated in it.

Liability

The Ligne d’horizon can be held liable only for direct damage caused by the school’s serious or intentional misconduct in the performance of its obligations arising from the contract concluded between the parties. The Ligne d’horizon cannot be held liable for indirect damage such as loss of income, loss of profits or any other form of non-material damage. The Ligne d’horizon cannot be held liable if a student disregards the safety instructions given. Students are responsible for their own behavior during the courses and workshops as well as for the use of use of the equipment and material put at their disposal. The Ligne d’Horizon cannot be held liable in case of injury or accident resulting from an inappropriate or negligent use of the material. The Ligne d’horizon reserves the right to exclude a student who does not comply with the rules, without any reimbursement being due. During the courses or workshops, participants explicitly commit to:

  • Inform the teacher of any allergies to the products used or the surrounding environment
  • Treat respectfully the other participants as well as the teacher
  • Handle with due care the material put at their disposal
  • Respect the premises where the course or workshop is conducted

Photos/videos, intellectual property

Except in case of prior objection, it shall be possible for the Ligne d’horizon to take photographs or videos of the participants during lessons and workshops. The Ligne d’horizon shall be allowed to publish such photos or videos on its website or social media, for the sole purposes of presenting and promoting its work. If a student does not wish to be photographed or filmed, he/she should inform the school by email at: info@lalignedhorizon.brussels.

Sales of sculpture materials

By purchasing material on this website, buyers acknowledge that they have read and accepted the following general conditions:

Price and VAT

  • The Ligne d’horizon sells on its website sculpture materials (clay, tools, storage bags etc).
  • Prices are expressed in euros and include VAT.
  • The Ligne d’horizon reserves the right to modify its prices at any time.
  • Any change in VAT will result in an automatic adjustment of prices. Purchases shall be charged on the basis of the prices in force at the time the order is confirmed, subject to availability.
  • The price paid at the time of the order is the price accepted by the customer. No discount can be applied subsequently to the order.
  • Accepted payment methods for purchases: credit card, bank transfer, bancontact.

Delivery and shipping costs

  • Our standard shipment method is by Bpost . Orders are shipped within 7 working days (unless they are out of stock or there are any other problems of which the Ligne d’horizon shall inform the customer by email).
  • Materials ordered on the website shall be delivered to the address indicated by the buyer at the time of the order.
  • The Ligne d’horizon cannot be held liable for delays in delivery due to the carrier;
  • Shipping costs shall be calculated at the time of the order, as a function of the order’s characteristics.
  • It is possible to ship everywhere in the world. As regards deliveries outside the European Union, the buyer engages to pay any import duties, customs duties, VAT or any other tax due according to the law of the country of destination of the order. The Ligne d’horizon declines all responsibility if the buyer does not pay such taxes.

Right to return products

  • The buyer has 14 calendar days to return the products, starting from the day after receipt of the products. The buyer can exercise this right without giving a reason. The buyer shall, however, notify in writing the Ligne d’horizon of its intention to exercise this right at info@lalignedhorizon.brussels before the expiry of the 14-day period.
  • Both the shipping costs and the shipping risks shall be borne by the buyer.
  • The right to return products is only applicable if the products are returned within 14 calendar days, starting from the date at which the buyer has notified its intention to return the items, to the following address: 13, rue Anoul, 1050 Bruxelles.
  • The returned item must be in its original state and packaging, not used, in perfect condition and accompanied by the order reference.
  • The Ligne d’horizon will reimburse the full price of the order (minus shipping costs), using the same method of payment used by the buyer, within 14 calendar days following the day of receipt by the Ligne d’horizon of the returned item, and provided all the above conditions are cumulatively met.
  • The reimbursed amount cannot, in any case, be higher than the price actually paid by the buyer.
  • This right of return does not concern professional buyers.

Damaged or faulty items

It is the buyer’s responsibility to verify the conformity and integrity of the parcel at the time of delivery of the order.

If your receive a damaged or defective article, please contact the Ligne d’horizon by email. According to the circumstances, you may be asked to provide photos of the articles concerned, with a view to its replacement. You may also opt for reimbursement of the item. The return of damaged products is free- of charge, provided the item is returned within 14 days. After 14 days, the legal warranty will intervene, and you will be asked to bear the shipping costs.

Tool bags for sculptors/ceramists

Our signature bags ‘Argile Crue’ are available for sale on our website. They are manufactured by women in India in an eco-sustainable company ensuring respect for human and labour rights. We have designed them ourselves and had them manufactured. Liability Products are sold within the limits of available stocks. If a product is not available, the Ligne d’horizon informs the buyer by email and may propose an alternative product of equivalent quality or price, or the reimbursement of the order, including shipping costs. The Ligne d’horizon cannot be held liable for products being out of stock, no longer available, or for cases of force majeure. No damages will be due to the buyer. Any photographs, visuals and text used to illustrate the products are not contractual. The Ligne d’horizon cannot be held liable in case of error, omission or modification of the product characteristics.

Common provisions

Acceptance

  • The present general conditions define the contractual relations between the Ligne d’horizon and the participant or/and buyer as well as the conditions applicable to all purchases carried out on this website.
  • The purchase of a product or service on this website implies the acceptance of these general conditions, which will prevail over any other general or specific conditions not explicitly agreed on by the Ligne d’horizon.
  • The Ligne d’horizon reserves the right to modify these general conditions at any time. In this case, the applicable conditions will be those at the time of the order being passed or the enrolment of a participant in a course.

Personal data (General Data Protection Regulation)

The personal data provided by the participants and/or buyers to the Ligne d’horizon are handled with care. the Ligne d’horizon undertakes to respect the private life of the users of the site and to protect their personal data.

The Ligne d’horizon collects and process personal data and addresses received from participants, buyers or any other contact persons (name, surname, date of birth, postal address, email address, telephone number, etc).

The information collected is used only for the discharge of the obligations under the contracts, the management of participants in the courses or workshops, the processing of orders, accountancy and direct promotion activities, such as the distribution of promotional or commercial information about the Ligne d’horizon. The relevant legal bases are the performance of the contract, the fulfilment of legal and regulatory obligation or the legitimate interests of the Ligne d’horizon.

Personal data are retained and processed for an appropriate period of time, depending on the objective of the processing and of the relationships (whether contractual or otherwise). The participants’ and buyers’ personal data will, in any event, be removed from our system after 7 years from the end of the contract, with the exception of personal data which we are required to retain for a longer period on the basis of specific legislation or in case of legal dispute requiring such personal data.

By communicating or providing their personal data, or by concluding a contract with the Ligne d’horizon, the participant or buyer agrees to the Ligne d’horizon collecting and using such personal data in conformity with this article.

In accordance with Belgian legislation on data protection and the provisions of the General Data Protection Regulation, we inform you that you enjoy the following rights:

  • Right of access: the participant/buyer has the right to request at any time information on, among others, the data which the Ligne d’horizon has registered about them, the objective of such registration, the categories of personal data and the possible addressee and information on the origin of the data. The participant/buyer has the right to receive a copy of the personal data processed by the Ligne d’horizon which concern them.
  • Right of rectification: the participant/buyer has the right to request that any incorrect or incomplete information concerning them is corrected or completed at any time on a simple request.
  • Right to the limitation of processing: the participant/buyer can ask for a limitation of data processing;
  • Right to data deletion (‘right to be forgotten’): without prejudice to the exceptions provided for by law, the participant/buyer has a right to require that its data be deleted.
  • Right to the portability of data: the participant/buyer can ask for their data to be transmitted in a format which is ‘structured, commonly used and machine-readable’.
  • Right to complain: the participant/buyer can introduce a complaint before the data protection authority.

The Ligne d’horizon undertakes to put in place the technical and organizational measures required to ensure an appropriate level of security so as to protect the confidentiality of the data. Participants and/or buyers can send a request by mail at info@lalignedhorizon.brussels. The Ligne d’horizon commits to reply to requests of modification or deletion of data within 1 month.

Intellectual property

All texts, comments, works, illustrations and images reproduced on the website are the property of the Ligne d’horizon. All forms of reproduction or use, even in part, is not allowed without a written authorization by the Ligne d’horizon.

Integral nature of the contract

Even if one of the conditions of this document were declared inapplicable, the other provisions shall nevertheless remain applicable

Liability

Although this website has been developed with the utmost care, the Ligne d’horizon cannot guarantee that the information provided is correct, complete and up-to-date. Therefore, the Ligne d’horizon cannot be held liable for the use made of the information provided on this website.

Applicable law and Jurisdiction

These general conditions of sale are governed by Belgian law. In the event of a dispute, the participant/buyer can, in a first step, contact the Ligne d’horizon to seek an amicable solution. If such a solution cannot be found, the dispute shall be brought before the Belgian courts. Unless otherwise agreed, the Ligne d’horizon reserves the right to bring the dispute before a French-speaking Brussels court.

Only the French version of these conditions of sale is authentic.
